PRIVACY POLICY

Data Protection Notice

Swimwerks Asia Pte. Ltd. may collect, use, disclose, or otherwise treat the personal data of our customers in accordance with the Personal Data Protection Act (“PDPA”) on the grounds outlined in this Data Protection Notice (“Notice”). This Notice is applicable to any personal information that we have in our possession or that is under our control, including any personal information that is in the possession of companies that we have hired to collect, use, disclose, or process personal information on our behalf.

 

Personal Data

Throughout this Notice: “Client” refers to a person who (a) has gotten in touch with us via any method to learn more about any products or services we offer, or (b) may have entered into a contract with us for the provision of any products or services by us; and “personal data” refers to information, whether true or false, about a customer who can be identified from that information alone or in combination with other data to which we have or are likely to have access. Name, residential address, email address, phone number, gender, and date of birth are some types of personal information that we may collect from you, depending on the nature of your engagement with us. The definitions of any other terminology used in this Notice are found in the PDPA (where the context so permits).

 

Collection, Use, & Disclosure of Personal Data

Unless (a) you voluntarily provide it to us directly or through a third party that has been properly authorized by you to disclose your personal information to us (your “authorized representative”), and I after you (or your authorized representative) have been informed of the purposes for which the data is collected and (ii) after you (or your authorized representative) have given written consent to the collection and use of your personal information, we generally do not collect your personal information. Before obtaining any new personal information about you or using it for a purpose for which you have not been informed, we will first get your permission (except where permitted or authorized by law). We may gather & use your personal information for any or all of the following reasons: to fulfill our duties in connection with or during the process of providing the goods and/or services you have requested; confirming your identification; receiving and processing your inquiries, requests, applications, complaints, and feedback; and replying to your questions; monitoring your interaction with us; handling credit or payment transactions; any other objectives for which you have submitted the information; compliance with any applicable laws, regulations, codes of practice, guidelines, or rules; or to help in law enforcement and investigations carried out by any governmental and/or regulatory authority; sending information to any unaffiliated third parties, such as our third-party service providers, agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; as well as any other incidental business purposes related to or in connection with the aforementioned. Your personal information may be disclosed to third-party service providers, agents, and other organizations we have hired to carry out any of the tasks related to the aforementioned purposes if the disclosure is necessary to comply with legal requirements during the course of or in connection with our provision of the goods and services requested by you. Even when your connection with us (for instance, under a contract) has ended or been changed in any way, the above terms may still be relevant for a reasonable amount of time afterward (including, where applicable, a period to enable us to enforce our rights under any contract with you).

 

Withdrawing Your Consent

Written withdrawal of your consent to the collection, use, & dissemination of your personal data will not affect the validity of the consent you first provided. By sending your request in writing or by email to our data protection officer at the address stated below, you can request that we stop collecting, processing, and/or disclosing your personal data for any or all aforementioned reasons. Upon receiving your written request to withdraw your consent, we may need a reasonable amount of time (depending on the complexity of your request & how it will affect our relationship with you) to process it, notify you of the results, & explain how they will affect your rights and obligations to us. Generally, after receiving your request, we will try to process it within five (5) business days. While we respect your decision to withdraw your consent, based on the nature and extent of your request, we might not be able to continue supplying you with our goods or services. If this is the case, we will let you know before we finish processing your request. If you decide to withdraw your consent, please let us know in writing by following the procedure outlined above. Please be aware that revoking consent has no bearing on our right to continue collecting, using, and disclosing personal information where doing so is allowed or required by relevant law.

 

Access to and Correction of Personal Data

If you wish to submit a written or electronic request to our Data Protection Officer at the address listed below, you may do so to request (a) access to a copy of the personal data we maintain about you or information about the ways in which we use or disclose your personal data, or (b) a correction of any inaccurate personal data we may have about you. Please be aware that an access request may be subject to a reasonable price. If so, we will let you know the cost upfront before handling your request. Your request will be addressed as soon as it is practical for us to do so. Generally, you may expect a response from us in five (5) business days. We shall notify you in writing within thirty (30) days of the period by which we will be able to reply to your request if we are unable to do so within thirty (30) days of receiving it. In general, we will advise you of the reasons we are unable to supply you with any personal data or make a correction that you have asked for (except where we are not required to do so under the PDPA).

 

Protection of Personal Data

We have implemented appropriate administrative, physical, and technical measures, such as encryption, use of privacy filters, and disclosing personal data both internally and to our authorized third-party service providers and agents only on a need-to-know basis, to protect your personal data from unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks. However, you should be aware that no technique of electronic storage or communication over the Internet is 100 percent secure. Although security cannot be guaranteed, we make every effort to safeguard your information and are always improving and assessing our information security procedures.

 

Accuracy of Personal Data

Typically, we rely on the personal information you have provided (or your authorized representative). Please notify our Data Protection Officer in writing or by email at the contact information provided below if there are any changes to your personal data so that we can make sure it is current, complete, and correct.

 

Retention of Personal Data

We may keep your personal information for as long as it takes to accomplish the task for which it was acquired or as long as allowed or required by relevant laws. When it is reasonable to infer that continuing to retain your personal data does not further the goals for which it was originally obtained and is no longer required for legal or business reasons, we shall stop doing so or erase the means by which the data can be used to identify you.

 

Personal Data Transfers Outside of Singapore

In general, we don’t send your personal information outside of Singapore. However, if we do, we will ask for your permission before transferring your personal data & take steps to guarantee that it is still protected to a quality at least as high as that required by the Personal Data Protection Act.

Effect of Notice and Changes to Notice

This Notice is in addition to any other notices, contractual provisions, and consent provisions that may be applicable with respect to the acquisition, use, and disclosure by us of your personal data. We reserve the right to update this Notice at any moment and without previous notice. By looking at the date this Notice was last updated, you can find out if any such changes have been made. RETURN & REFUND POLICY

 Returns

Our warranty period is 14 days. Unfortunately, we are unable to provide you with a refund or exchange after 14 days have passed since your purchase. Your item must be brand-new and in the same condition as you received it in order to be eligible for a return. Additionally, it must be in its original packing. We will send you an email to let you know that we have received your returned item after it has been received and examined. The acceptance or denial of your refund will also be communicated to you by us. Within a predetermined number of days of receiving your approval, your refund will be processed and a credit will automatically be credited to your credit card or original mode of payment.

 

Late or Missing Refunds

Check your bank account first if you haven’t gotten a return yet. Then get in touch with your credit card provider because it can take some time for the refund to appear on your account. Contact your bank next. Before a refund is posted, there is frequently a processing period. Please email us at operations@swimwerks.com.sg if you’ve done all of this and you still have not gotten your refund. Unfortunately, only regular priced items may be returned; sale items are not eligible.

 

Sale Items

The expense of your own shipping for returning your goods is your responsibility. The cost of shipping is not refundable. The cost of return postage will be subtracted from your refund if you get one. The amount of time it takes for the exchanged item to get to you will depend on where you reside.
